An amendment to the Employment Relations Act 2019 came into force on 28 June 2020. It enables an employee to include a ‘controlling third party’ in a personal grievance claim.
A triangular employment arrangement has three parties to an employment agreement:
- Employer (e.g. recruitment agency)
- Employee (e.g. receptionist)
- Controlling third party (e.g. law practice)
Note: employers can also apply to add a controlling third party to a personal grievance – not just employees, though it is most likely to be the employees making the application.
